Terms of service

These terms are the agreement between you and Erre Agency LLC, a limited liability company in the State of Georgia, United States, for your use of Erre OS. Erre OS is the software at erreos.com, app.erreos.com, and the Erre OS mobile app.

By creating an account or using Erre OS, you accept these terms. If you do not accept them, do not use the product.

Agency work with Erre Agency is a separate relationship under separate terms. Those are at erreagency.com/terms-of-service. Where a signed agreement between us says something different from this page, the signed agreement wins.

Who can use Erre OS

You must be at least 18 years old. If you sign up for a company, you confirm you are allowed to accept these terms on its behalf, and from that point "you" means the company as well as you.

Your account

• Give us accurate details, and keep them current.
• Keep your password and your devices secure. What happens under your account is your responsibility.
• One login is one person. Do not share a login. If two people need access, add a second seat.
• Tell us straight away if you think someone else has got into your account.

Plans and seats

Erre OS is sold as a monthly or annual subscription in US dollars. A year costs ten times the monthly price.

• Solo. 29 dollars a month, or 290 dollars a year. 1 seat. 15 GB of file storage.
• Team. 79 dollars a month, or 790 dollars a year. 5 seats. 50 GB of file storage.

A seat is one person who can sign in, or one invitation you have sent that has not expired yet. When your seats are full, you either remove someone or move up a plan. Single files are capped at 100 MB each.

We can change prices. If we do, we will tell you by email at least 30 days before the change reaches your account, and you can cancel before it does.

Billing and renewal

• Your subscription starts when your first payment goes through, and it renews by itself on that same calendar day, every month on a monthly plan or every year on an annual one, until you cancel.
• Cards are handled by Stripe. Subscriptions are managed through Autumn. Erre OS never sees your full card number.
• Keeping a working payment method on file is your responsibility. Prices exclude any tax we are required to collect.
• A free trial exists only if we have given you one in writing. There is no automatic trial.

If a payment fails

A failed payment does not cancel your account and it does not stop what you owe. We keep your workspace fully open for four days while we retry and while we email you about it. After that the workspace becomes read only. You can still see everything in it, but nobody can add or change anything until the payment clears. Fix the card and full access returns.

Cancelling

Cancel any time from Settings, under Billing. Nobody has to be phoned and nothing has to be negotiated.

Cancellation takes effect at the end of the period you have already paid for. You keep full access until then. After that the workspace goes read only rather than disappearing, so your records are still there if you come back. Ask us to delete it and we will.

Refunds

Payments are not refundable. That includes partial months or years, unused seats, and unused time after a cancellation. Cancelling stops the next charge, it does not reverse the last one. If we have made a billing mistake, tell us and we will fix it.

What you may not do

You agree not to use Erre OS to do any of the following.

• Break the law, or help someone else break it.
• Upload malware, or content you have no right to hold, or content that is illegal to store.
• Harass, threaten, or impersonate anyone.
• Send spam, or use our email sending to reach people who did not ask to hear from you.
• Get into an account, a workspace, or a system you were not given access to, or try to.
• Probe, scan, load test, or attack the service without our written permission first.
• Resell Erre OS, rent it out, or run it as a service for other businesses, unless we have agreed that in writing.
• Copy the product, take it apart, or reverse engineer it.
• Work around a seat limit, a storage quota, or a rate limit.

Your data stays yours

Everything you put into Erre OS belongs to you. Your tasks, your messages, your documents, your files, your customer records. Ours is the software.

You give us the permission we need to run the product for you, which is to store your data, back it up, transmit it, and show it to the people you have given access to. That permission covers nothing else. We do not sell your data, we do not use it for advertising, and we do not use it to train artificial intelligence models.

You are responsible for having the right to hold what you upload, including the personal data of your own customers and staff. How we handle personal data is set out in our privacy policy.

You can export or copy your data while your account is open. Ask support if you need help getting it out.

Our software stays ours

Erre OS, its design, its code, and the Erre name and marks belong to Erre Agency LLC. Your subscription is permission to use the product, not a transfer of any of it. Feedback you send us is something we can act on freely and without owing you anything for it.

Availability

We work hard to keep Erre OS running and we do not promise it always will be. There is no uptime guarantee, no service level agreement, and no credit for downtime. The product is provided as it is.

Erre OS depends on services we do not control, including hosting, storage, payment processing, email delivery, and Google. When one of them fails or changes, parts of Erre OS can fail with it, and that is outside our control.

We may take the service down for maintenance. Where the work is planned, we will give notice if we reasonably can.

Connecting other services

Some features connect to accounts you hold elsewhere, such as Google Calendar. Connecting one is your choice, you can disconnect it whenever you want, and while it is connected you are also bound by that provider's own terms. We are not responsible for what those services do.

Changes to the service

Erre OS changes. We add things, we improve things, and sometimes we retire something that is not working. If we remove a feature you rely on or make a material change against you, we will give reasonable notice, and if the change does not suit you, you can cancel.

Suspension and termination

We can suspend or close an account that breaks these terms, that is being used to harm someone, that puts the service or other customers at risk, or that is unpaid. Where the situation allows it, we will warn you first and give you a chance to fix it. Where it does not, such as an active attack, we will act first and explain afterwards.

You can close your account any time by cancelling. On termination, your right to use Erre OS ends, anything you still owe becomes due, and the sections of these terms that are meant to outlive the agreement do.

No guarantee of results

Erre OS is a tool. It does not promise you more revenue, more jobs, or a better run business. What you get out of it depends on what you and your team put into it.

To the fullest extent the law allows, we disclaim all warranties, express and implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limits on liability

To the fullest extent the law allows, Erre Agency LLC is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, lost business, or lost or corrupted data.

Our total liability for any claim will not exceed the amount you paid us for Erre OS in the billing cycle before the claim arose.

Some places do not allow these limits. Where that is true, they apply to you only as far as the law there permits.

Indemnity

You agree to cover us against claims, losses, and reasonable legal costs that come from your use of Erre OS, from what you put in it, or from your breach of these terms.

Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Disputes go to the state and federal courts sitting in Georgia, and both of us agree to their jurisdiction.

Changes to these terms

We may update these terms. When we do, we change the date at the top of this page. For a material change, we will tell you by email or in the app before it takes effect. Carrying on with Erre OS after that means you accept the new version.

The rest

• These terms, plus the privacy policy and any signed agreement, are the whole agreement between us about Erre OS.
• If a court strikes out part of these terms, the rest stays in force.
• Not enforcing something once does not mean we have given it up.
• You cannot transfer this agreement without our written consent. We can transfer it in a merger, acquisition, or sale of assets.
